The material fact in this case is that Federman was being taken into custody for a mental health evaluation, not a criminal offense. It was an unreasonable use of force to even activate a SWAT team for this incident, given the fact that there simply had not been a violent crime. This entire incident escalated to the point of the suspect being killed due to the poor leadership and atrocious decision-making by the officers on scene.
